Legal Notice

This Legal Notice, available at astrolegal.net, sets out the general information about AstroLegal that is required under applicable law, together with the general conditions governing access to and browsing of the Website. This Legal Notice is separate from the Terms and Conditions of the Services, which govern the request for and use of the Services, and from the privacy notice and the cookie notice. Each of those documents governs its own subject matter and should be consulted for the matters it covers.

Art. 1. IDENTIFICATION DETAILS

1.1 Pursuant to Article 10(1)(a) of the LSSI, AstroLegal’s identification details are as follows: name: “AstroLegal”; place of business: Avenida Touroperador Neckermann 3, 35100 Maspalomas, Las Palmas, Spain; email address: info@astrolegal.net, which serves as the contact address through which direct and effective communication with AstroLegal may be established.

1.2 Pursuant to Article 10(1)(b) of the LSSI, AstroLegal operates as a self-employed individual (autónomo), registered with the Spanish tax authorities (Hacienda) and with the Special Social Security Scheme for Self-Employed Workers (RETA).

1.3 Pursuant to Article 10(1)(c) of the LSSI, the activity carried out by AstroLegal is not, as such, subject to any requirement of prior administrative authorisation.

1.4 Pursuant to Article 10(1)(d) of the LSSI, and in accordance with Article 4.2 of the Terms and Conditions of the Services, the Quote issued for each matter provides the Client with the following information about the Assigned Professional handling that matter: (i) the details of the professional association with which the Assigned Professional is registered, and the Assigned Professional’s registration number; (ii) the Assigned Professional’s academic or professional qualification; and (iii) the professional rules applicable to the Assigned Professional and the means by which they may be consulted.

1.5 Pursuant to Article 10(1)(e) of the LSSI, AstroLegal’s tax identification number is NIE Z1622112-L.

1.6 Pursuant to Article 10(1)(f) of the LSSI, the prices of the Services are published on the Website and, for each matter, set out in the Quote, with an indication in each case of whether applicable taxes are included, as provided in the Terms and Conditions of the Services.

1.7 Pursuant to Article 10(1)(g) of the LSSI, as at the date of this Legal Notice AstroLegal does not adhere to any code of conduct.

Art. 2. PURPOSE AND SCOPE

2.1 This Legal Notice sets out the general conditions governing access to and browsing of the Website by any person visiting it (the “User”), whether or not that person requests any of the Services. By browsing the Website, the User accepts this Legal Notice.

2.2 The process for requesting the Services, the identification of the Assigned Professional and the financial terms applicable to the Services remain governed by the Terms and Conditions of the Services. The processing of personal data is governed by the privacy notice, and the use of cookies and similar technologies is governed by the cookie notice.

Art. 3. GENERAL CONDITIONS OF USE OF THE WEBSITE

3.1 The User undertakes to use the Website in accordance with the law, this Legal Notice, generally accepted moral standards and public order, and not to use the Website for any purpose, or in any manner or with any effect, that is unlawful, that is prejudicial to the rights of AstroLegal or of third parties, or that could otherwise damage, overload or impair the operation of the Website.

3.2 AstroLegal reserves the right to make such changes to the Website as it deems appropriate, at any time and without prior notice, and may accordingly update, correct or remove any of its content. The foregoing is without prejudice to Article 13 of the Terms and Conditions of the Services concerning the availability of the Website.

Art. 4. INTELLECTUAL AND INDUSTRIAL PROPERTY

4.1 The Website, its structure, source code, texts, images, trademarks (including the “AstroLegal” sign), logos and all other material contained in it are protected by the applicable intellectual and industrial property laws. They remain the exclusive property of AstroLegal or its licensors, as also provided in Article 8.2 of the Terms and Conditions of the Services, which is incorporated into this Legal Notice by reference.

4.2 The reproduction, distribution, communication to the public or transformation of the content of the Website, in whole or in part, by any means and in any form, is prohibited, except with the prior written consent of AstroLegal or where expressly permitted by law.

Art. 5. LINKS TO THIRD-PARTY WEBSITES

5.1 The Website may contain links to pages or websites operated by third parties. AstroLegal has no control over such websites or their content. AstroLegal accepts no liability for their lawfulness, availability, quality or reliability, or for any processing of personal data carried out on them, which remains governed by their respective privacy notices.

5.2 The inclusion of a link to a third-party website does not imply any relationship between AstroLegal and the owner or operator of that website, or any endorsement by AstroLegal of its content or services.

Art. 6. EXCLUSION OF WARRANTIES AND LIABILITY

6.1 AstroLegal does not warrant that the content of the Website is error-free or that access to the Website will be uninterrupted, and shall not be liable for any damage arising from the User’s use of the Website in breach of this Legal Notice or of applicable law. This Article 6 is without prejudice to Article 10 of the Terms and Conditions of the Services concerning the limitation of liability in respect of the Services. However, liability for wilful misconduct (dolo) or gross negligence (culpa grave) is not excluded in any case, in accordance with Article 1102 of the Spanish Civil Code (Código Civil) and the case law interpreting that provision, as also stated in Article 10.1 of the Terms and Conditions of the Services.

Art. 7. AMENDMENTS

7.1 AstroLegal may amend this Legal Notice to reflect legislative, regulatory, technological or organisational changes, or to ensure that it continues to contain the information required under Article 10 of the LSSI. AstroLegal shall give notice of any such amendment by publishing the amended Legal Notice on the Website, together with the date of the amendment.

Art. 8. GOVERNING LAW AND JURISDICTION

8.1 This Legal Notice is governed by Spanish law.

8.2 For Users who do not qualify as consumers, any dispute relating to the validity, interpretation or performance of this Legal Notice shall be subject to the exclusive jurisdiction of the courts of San Bartolomé de Tirajana (Juzgados de San Bartolomé de Tirajana), unless AstroLegal and the User agree otherwise in writing.

8.3 Users who qualify as consumers retain the right to bring proceedings before the courts of their own domicile under Article 52 of the Spanish Civil Procedure Act (Ley de Enjuiciamiento Civil). Where such a User is domiciled in another Member State of the European Union, the User retains that right under Articles 17 to 19 of Regulation (EU) No 1215/2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (recast) (the “Brussels I bis Regulation”). Users who qualify as consumers also retain the benefit of any mandatory consumer protection rules that may apply under Article 6 of Regulation (EC) No 593/2008 on the law applicable to contractual obligations (the “Rome I Regulation”).
